IV ELEMENTS offers an SMS/text messaging program to provide you with appointment reminders, health and wellness tips, promotional offers, service updates, and other communications related to our IV therapy and alternative medicine services. By opting into our SMS program, you agree to the following terms:

  • How to Opt In

You may opt in to receive SMS/text messages from IV ELEMENTS by:

  • Providing your mobile phone number and checking the SMS consent box on our website contact or intake form;
  • Texting a designated keyword (e.g., JOIN) to our SMS short code or long code;
  • Verbally consenting to SMS communications with a staff member, followed by written confirmation; or
  • Any other method by which you expressly provide written consent to receive text messages from IV ELEMENTS.

By opting in, you consent to receive recurring automated marketing and informational text messages from IV ELEMENTS at the mobile number you provide. Consent is not a condition of purchase. Message frequency may vary.

After opting in, you may receive the following types of text messages from IV ELEMENTS:

  • Appointment reminders and scheduling confirmations
  • Health and wellness tips related to IV therapy and hydration
  • Promotional offers, discounts, and special events
  • Service updates and new treatment announcements
  • Follow-up care instructions or post-treatment reminders

  • Message and Data Rates

Message and data rates may apply. These charges are billed by and payable to your mobile service provider. IV ELEMENTS is not responsible for any charges incurred from your mobile carrier in connection with SMS messages. Please contact your mobile carrier if you have questions about applicable fees.

  • How to Opt Out (STOP)

You may opt out of receiving SMS/text messages from IV ELEMENTS at any time by:

  • Replying STOP to any text message you receive from us;
  • Texting STOP to our SMS number;
  • Emailing your opt-out request to info@ivelements.net with your name and mobile number; or
  • Calling us at (888)-611-3747 and requesting to be removed from our SMS list.

After you send STOP, you will receive one final text message confirming that you have been unsubscribed. Following that confirmation, you will no longer receive SMS messages from IV ELEMENTS unless you opt in again. Opting out of SMS messages does not affect other communications such as email or phone calls.

  • Help

  • Supported Carriers

Our SMS service is available on all major U.S. wireless carriers including, but not limited to: AT&T, Verizon, T-Mobile, Sprint, Boost Mobile, MetroPCS, and others. Carrier support may vary. IV ELEMENTS is not responsible for delays or failures in the receipt of any SMS messages connected to errors in the network.

  • No Sharing of SMS Consent Data

IMPORTANT: Your mobile phone number and SMS opt-in consent are collected solely for the purpose of sending you text messages from IV ELEMENTS. We do not sell, rent, share, or transfer your mobile phone number or SMS consent data to any third party or affiliate for their own marketing or messaging purposes. This data will not be used by any third party for the purpose of marketing via SMS, text messages, or any other electronic communication channel. This restriction applies regardless of any other data-sharing provisions in this Privacy Policy.

  • SMS Data Retention

We retain records of your SMS opt-in consent (including date, time, and method of consent) for a minimum of four (4) years to comply with applicable federal and state regulations. If you opt out, your mobile phone number will be added to our do-not-contact list and will not be used for future SMS campaigns.

  1. Email Marketing Communications

IV ELEMENTS may send you marketing and promotional emails when you provide your email address and consent to receive such communications. All commercial email communications from IV ELEMENTS comply with the federal CAN-SPAM Act of 2003, as well as applicable New York and New Jersey state law requirements.

Every marketing email we send will:

  • Clearly identify IV ELEMENTS as the sender;
  • Include a valid physical mailing address (36 Newark Street, Suite 402, Hoboken, NJ 07030);
  • Contain a clear and conspicuous opt-out/unsubscribe link or mechanism;
  • Honor opt-out requests within ten (10) business days; and
  • Not use deceptive subject lines or misleading header information.

To unsubscribe from our marketing emails at any time, click the “Unsubscribe” link found in any email we send, or email us directly at info@ivelements.net with “Unsubscribe” in the subject line. Please note that even if you unsubscribe from marketing emails, we may still send you transactional or service-related emails necessary to complete a transaction or provide a service you requested.

  1. New Jersey and New York Privacy Rights. New Jersey Consumer Rights

Effective January 15, 2025, the New Jersey Data Privacy Act (NJDPA) grants New Jersey residents certain rights with respect to their personal data. If you are a New Jersey resident, you have the right to:

  • Know whether we are processing your personal data and to access such data;
  • Correct inaccuracies in your personal data, taking into account the nature of the personal data and the purposes for which it is processed;
  • Delete personal data that you have provided or that we have collected about you;

We may extend the response period by an additional 45 days when reasonably necessary, provided we notify you of the extension within the initial 45-day period. We do not charge a fee for the first request in a 12-month period; however, we may charge a reasonable fee for subsequent requests.

New Jersey SMS and Email Marketing: Under New Jersey law, we require affirmative consent before sending marketing text messages or commercial emails. Residents may revoke consent at any time by replying STOP (for SMS) or clicking Unsubscribe (for email). We honor all opt-out requests promptly and maintain records of consent as required by New Jersey regulations.

New Jersey Do Not Call: IV ELEMENTS complies with the New Jersey Do Not Call Registry Act (N.J.S.A. 56:8-119 et seq.). We will not contact New Jersey residents registered on the New Jersey Do Not Call Registry for telemarketing or promotional purposes without prior written consent. If you are registered on the NJ Do Not Call Registry and believe you have received an unauthorized call from IV ELEMENTS, please contact us at info@ivelements.net.

  • New York Consumer Rights

IV ELEMENTS complies with applicable New York State privacy and consumer protection laws, including the New York SHIELD Act (Stop Hacks and Improve Electronic Data Security Act), effective March 21, 2020, and the New York Consumer Protection Act.

New York SHIELD Act Compliance: IV ELEMENTS maintains reasonable administrative, technical, and physical safeguards to protect the security of New York residents’ private information. In the event of a data breach that includes private information of New York residents, we will notify affected individuals and the New York Attorney General in accordance with the timelines and procedures set forth in the SHIELD Act. “Private information” under the SHIELD Act includes information such as Social Security numbers, driver’s license numbers, financial account numbers, and biometric information combined with a name or other identifying information.

New York Email Marketing: IV ELEMENTS complies with New York’s consumer protection laws governing commercial email communications. We will not send commercial email to New York residents without prior consent and will honor all unsubscribe requests within ten (10) business days.

New York SMS Marketing: IV ELEMENTS complies with all applicable New York regulations regarding SMS/text message marketing. We require express written consent prior to sending marketing text messages to New York residents and will immediately honor all STOP requests. We do not send text messages to New York residents outside of the hours of 8:00 AM to 9:00 PM Eastern Time.

  • Federal Law Compliance

In addition to state law compliance, IV ELEMENTS complies with all applicable federal laws governing communications and data privacy, including:

  • Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227: We obtain express written consent before sending automated marketing text messages and calls. We maintain do-not-call and do-not-text lists and honor all revocations of consent.
  • CAN-SPAM Act, 15 U.S.C. § 7701 et seq.: All commercial emails comply with CAN-SPAM requirements including accurate sender identification, opt-out mechanisms, and prompt processing of unsubscribe requests.
  • Health Insurance Portability and Accountability Act (HIPAA): To the extent we handle protected health information (“PHI”) in connection with our medical services, we comply with HIPAA’s Privacy Rule and Security Rule. Any SMS or email communications involving PHI will be handled in accordance with applicable HIPAA requirements and our HIPAA Notice of Privacy Practices.
  • The Campaign Registry (TCR) Compliance: All SMS campaigns conducted by IV ELEMENTS comply with The Campaign Registry’s regulations and applicable CTIA Messaging Principles and Best Practices. We maintain accurate campaign registrations and ensure all messages sent through our registered campaigns adhere to TCR requirements, including message content standards, opt-in/opt-out procedures, and message frequency disclosures.
  1. Social Sharing Features

The Platform may offer social sharing features and other integrated tools, which let you share actions you take, or post reviews on our Platform with other media, and social media and vendor platforms and vice versa. Your use of such features and your uploading of any content or material to the Platform enables the sharing of information with your friends or the public, depending on the settings you establish with the entity that provides the social sharing feature. For more information about the purpose and scope of data collection and processing in connection with social sharing features, please visit the privacy policies of the entities that provide these features.

  1. Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Platform, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including, but not limited to:

  • Targeted Advertising. If you do not want us to use information to deliver targeted advertisements, you can opt-out by logging into the Platform and adjusting your user preferences.
  1. Accessing and Correcting Your Information

You can review and change your personal information by logging into the Platform and visiting your account profile page. You may also send us an email at info@ivelements.net to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account.

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure, consistent with our obligations under the New York SHIELD Act and applicable New Jersey law. All information you provide to us is stored on our secure servers behind firewalls.

The safety and security of your information also depends on you. Where we have given you a password for access to certain parts of our Platform, you are responsible for keeping this password confidential. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Platform. Any transmission of personal information is at your own risk.

🌿 Story time with our nurse: A 40-year-old client came in struggling with extreme fatigue, brain fog, weakness, and numbness in her hands and feet.
